However, <strong>public powers often perceive protest as a threat,<\/strong> and only treat it as a public order issue. It is precisely in these situations when the highest number of instances of abuse or disproportional use of force are encountered. This has been claimed on many occasions by human rights Special Rapporteurs, and the United Nations Human Rights Council itself.<\/p>\n<p class=\"p1\">Aix\u00ed doncs, el reconeixement, <strong>la protecci\u00f3 i la garantia del dret a la protesta \u00e9s una obligaci\u00f3 per part de totes les administracions p\u00fabliques, i \u00e9s, tamb\u00e9, un bon indicador de l\u2019estat de salut d\u2019una democr\u00e0cia.<\/strong> Estat de salut que, malauradament, no \u00e9s el desitjable actualment, com a conseq\u00fc\u00e8ncia del greu retroc\u00e9s en la garantia dels drets a la llibertat d\u2019expressi\u00f3, a la llibertat d\u2019informaci\u00f3, aix\u00ed com al dret de reuni\u00f3 i manifestaci\u00f3 tant en el marc de l\u2019Estat espanyol com a Catalunya, aix\u00ed com tamb\u00e9 en el context europeu i internacional.<\/p>\n<p>Therefore, acknowledging, <strong>protecting and guaranteeing the right to protest is an obligation for all public administrations and it is also an important indicator of a democracy\u2019s state of health.<\/strong> Unfortunately, many modern democracies are currently ailing as a consequence of a general tendency towards the repealing of such rights. The right to freedom of speech, freedom of information and freedom of assembly are at stake both in Spain and Catalonia, as well as in European and international contexts.<\/p>\n<p>For this reason, this report looks into the right to protest and its current state internationally as well as within Spain. It will then focus on the analysis of the right of protest in Catalonia between 2017 and 2019.<\/p>\n<p class=\"p1\">El present informe pren com a refer\u00e8ncia, m\u00e9s enll\u00e0 del context sociopol\u00edtic actual, la tasca desenvolupada pel Servei d\u2019Atenci\u00f3 i Den\u00fancia en situacions de Viol\u00e8ncia Institucional <strong>(SAIDAVI)<\/strong> d\u2019Ir\u00eddia. Aix\u00f2 no obstant, hi incorpora tamb\u00e9 dades i posicionaments d\u2019altres organitzacions i institucions p\u00fabliques sobre la mat\u00e8ria, per tal de tenir una mirada \u00e0mplia sobre la q\u00fcesti\u00f3.<\/p>\n<p>In addition to the current social and political context, this report is based on the work of <strong>SAIDAVI<\/strong> (Service of Attention and Denunciation in situation of Institutional Violence) and it also includes data and opinions of other organizations and public institutions in order to broaden the point of view on this topic.<\/p>\n<p class=\"p1\">Una societat mobilitzada i amatent per a la defensa dels seus drets \u00e9s un pilar fonamental per a qualsevol democr\u00e0cia; \u00e9s el que s\u2019anomena la<strong> garantia social dels drets.<\/strong> Per\u00f2 no \u00e9s pot oblidar que les obligacions en el reconeixement, protecci\u00f3, respecte i garantia dels drets humans recauen en primer lloc en les institucions p\u00fabliques. <strong>Especialment en moments com l\u2019actual, d\u2019una forta regressi\u00f3 en els drets i llibertats.<\/strong><\/p>\n<p>A participative society that fights to guarantee its rights is a fundamental mainstay in any democracy. It is called <strong>social guarantee of rights<\/strong>. However, we can\u2019t forget that the obligation of acknowledging, protecting, respecting and guaranteeing human rights is the duty of public institutions.<\/p>\n<p>Now more than ever, institutions have to have the will and decisiveness needed in order to revert this tendency; they need <strong>rigorous public policies based on guaranteeing rights. <\/strong>The aim of this report is to contribute to developing those public policies, using work done by an organization that specialises in civil and political rights, and more specifically, in the impacts and consequences that institutional violence generates, and how to face it from the point of view of rights and penal guarantees.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Read the Report here Since the Area Right to Protest of Ir\u00eddia we have elaborated the Report The right to protest in Catalonia, with the support of the Office of Civil and Political Royalties of the Generality of Catalonia.
